About Mediact

Mediact (“Mediact”, “we”, “us”, “our”) is a transmedia studio creating films, animations, visual identities, and related interactive experiences for clients and audiences.

These Terms & Conditions (“Terms”) govern your use of our website mediact.co (the “Site”) and any content, information, and services available through it (collectively, the “Services”). By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Site.

Eligibility & Use of the Site

You may use this Site only for lawful purposes and in accordance with these Terms. By using the Site, you represent that:

  • You are at least the age of majority in your province, state, or country of residence; and
  • You will not use the Site for any purpose that is unlawful or prohibited by these Terms.

You agree not to misuse the Site, including by attempting to gain unauthorized access to any systems or data, disrupting the operation of the Site, or using the Site in a way that could damage Mediact or others.

Intellectual Property

Unless otherwise stated, all content on the Site, including but not limited to text, images, graphics, animations, video, audio, logos, trademarks, and layouts (collectively, the “Content”), is owned by or licensed to Mediact and is protected by copyright, trademark, and other intellectual property laws.

You may view the Content for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content without our prior written consent, except as permitted by mandatory law.

Any unauthorized use of the Content may violate intellectual property laws and these Terms.

Showcasing Client Work & Case Studies

As a transmedia studio, we may showcase selected client work, case studies, and related assets on the Site for portfolio and promotional purposes. We do so under the terms agreed with each client.

Nothing on the Site grants you any rights to use client logos, trademarks, artwork, or any other protected content. You may not reuse or redistribute such materials without explicit written permission from the relevant rights holder.

User Submissions & Contact

If you contact us via forms, email, or other channels through the Site (for example, to request a quote or collaborate), you agree that:

  • The information you provide is accurate and not misleading.
  • You have the right to share any files, links, or references you send us.

We will treat your communications in accordance with our Privacy Policy. We do not accept unsolicited confidential ideas, and sending concepts or proposals does not create any obligation for Mediact unless we sign a separate written agreement.

Third‑Party Links

The Site may contain links to third‑party websites or services that are not owned or controlled by Mediact. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third‑party sites or services.

Links are provided for convenience only and do not imply endorsement. Your use of third‑party sites is at your own risk and subject to the terms and policies of those sites.

No Warranties

The Site and all Content are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied.

To the fullest extent permitted by applicable law, Mediact disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error‑free;
  • Any defects will be corrected; or
  • The Site or any content is accurate, complete, or up‑to‑date.
Limitation of Liability

To the fullest extent permitted by applicable law, Mediact and its directors, employees, partners, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the Site;
  • Any conduct or content of any third party on the Site;
  • Any content obtained from the Site; or
  • Unauthorized access, use, or alteration of your transmissions or content.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Mediact and its directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the Site;
  • Your violation of these Terms; or
  • Your violation of any rights of another person or entity.
Changes to the Site and to These Terms

We may update the Site and these Terms from time to time. Any changes to the Terms will be posted on this page with an updated “Last updated” date.

Your continued use of the Site after changes have been published will signify your acceptance of the revised Terms.

Governing Law & Jurisdiction

These Terms and your use of the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, and you consent to the personal jurisdiction of those courts.
